1. Acceptance of Terms

By accessing or using Dochives ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Dochives is a cloud-based document signing platform that allows users to create, send, sign, and manage documents electronically. The Service includes template creation, remote signing via secure links, document tracking, and audit trail generation.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Electronic Signatures

By using the Service to sign documents, you acknowledge and agree that electronic signatures created through Dochives are legally binding and enforceable under applicable laws, including the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA). You are responsible for ensuring that electronic signatures are appropriate for your specific use case.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to facilitate illegal activities
• Upload documents containing malware, viruses, or harmful code
• Attempt to gain unauthorized access to other users' accounts or documents
• Impersonate another person or entity when signing documents
• Use the Service to send unsolicited or spam signing requests
• Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

The Service, including its design, features, and content, is owned by Dochives and protected by intellectual property laws. You retain ownership of all documents and content you upload to the Service. By uploading content, you grant Dochives a limited license to process and store your content solely for the purpose of providing the Service.

7. Subscription and Billing

Paid plans are billed on a recurring monthly basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to modify pricing with 30 days' notice.

8. Data Retention and Deletion

We retain your documents and account data for the duration of your account. Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by law or for legitimate business purposes such as audit trail preservation.

9. Limitation of Liability

To the maximum extent permitted by law, Dochives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dochives operates, without regard to conflict of law principles.
